Tinubu Grants Clemency, Transfers Mercy Committee to Justice Ministry

President Bola Ahmed Tinubu has approved the release of some convicts under his constitutional powers of prerogative of mercy, while ordering the relocation of the Presidential Advisory Committee on Prerogative of Mercy from the Ministry of Special Duties to the Federal Ministry of Justice.

According to a statement by Bayo Onanuga, Special Adviser to the President on Information and Strategy, Tinubu signed the instruments of clemency after wide consultations with the Council of State and a review of public feedback on the exercise.

The President, however, directed a fresh review of the earlier approved list to ensure that only deserving individuals benefit. Consequently, persons convicted of serious crimes including kidnapping, drug trafficking, human trafficking, fraud, and illegal possession of firearms were excluded, while some sentences were commuted rather than pardoned outright.

The statement explained that the review considered the security implications of certain offences, the feelings of victims, and the need to maintain public confidence in the justice system.

“The concept of justice as a three-way traffic for the accused, the victim, and the state guided the review,” the statement read.

The updated list of eligible beneficiaries has been forwarded to the Nigerian Correctional Service for implementation.

In a move aimed at strengthening transparency and ensuring future exercises meet legal standards, President Tinubu directed the Attorney-General of the Federation to develop clear guidelines for the use of the prerogative of mercy, including mandatory consultations with relevant prosecuting agencies.
